Changes to planning laws

Changes of planning law came into effect on 1 October to allow the ancillary space above retail shops (either A1 or A2) to be converted into residential use without the need to obtain planning permission. The main conditions to comply with are:

  • The retail use is on a floor below the residential part of the building.
  • There remains a ground floor shop frontage/display window.
  • No more than two residential flats are created as a result of the change of use.

It is intended to aid the government’s attempt to bring vacant and underused properties back into use and should encourage redevelopment of town centres.  Building regulation approval will still be required.
