Furlough: Portal now open!

The much awaited HMRC portal for employers to make claims under the Coronavirus Job Retention Scheme (Scheme) is now open and can be accessed via the Government Gateway here.

The Government has also published a calculator that will assist employers to calculate 80% of furloughed staff wages; this can be found here.

The Scheme guidance has once again been updated and you can see the latest version here. However, as there appear to be some contradictions between the guidance and the Treasury Direction (mainly with regard to the way in which employees’ agreement to furlough can be confirmed), we expect further revisions before the end of the week.

The latest guidance does however confirm that not only will holiday entitlement continue to accrue during a furlough period, but that furloughed employees can take holiday without breaching the terms of the furlough. Further, any furloughed worker that does take holiday must be paid at their normal rate of pay, which means the employer will have to top up the 80% over and above the sums they receive via the Scheme.

If you have any questions about the Scheme, please email or call our Employment Law team today on 0113 207 0000.
